I am wondering just how hard it would be to terminate a birth fathers rights in the state of Maryland. I see that Maryland Statue says:
Parental consent is not needed
The child has been out of the parent's custody for one year and has formed a significant attachment to the petitioner.
The child has been abandoned.
The parent has failed to maintain meaningful contact with the child or to support the child.
Would the above apply if the birth father sent in contested forms to the court house, but has done nothing since then- We have had custody since birth till now almost 18 months. Does a birth father need to do more then just send in contested forms? The birth father has wavered back and forth on his decision. When the baby was 3 months he changed his mind had us re-draw up the paperwork to sign over his rights-that never happened. He then agreed to open adoption and then weeks later said he wanted the baby. That was said almost seven months ago-since then he has done nothing-We are told the longer we have the baby and with the birth father not doing anything the better our chances...Please if anyone knows if this Statue would help us...let us know!! thank you...:thanks:
