In 2008 we were given a baby by a young lady who didn't even know us. We hired a lawyer and got "custody" of the baby and our plan from the very beginning was adopting. A few months later we were given a newborn by the same lady. She has signed all the papers and is agreeable to adoption. We went a year before finally going in front of the judge to have the BF rights terminated, at this time he did show up and wanted to contest. We have had custody of the babies for 2 years now and I am just wondering if anyone on here has been through a similar situation. We have not had any kind of request for visitation from him nor any kind of monetary support from the BF. Looking for any bit of information...

What efforts did the mother or you make to contact him when you took custody? What efforts to contact him or involve him or request support while you've had the children? What real opportunity did he have to take custody, provide support, or engage in visitation himself then or during this time?

Thanks for the reply...He was served 3 times prior to the hearing to terminate his rights. He has known who our lawyer was from day one and we have never had any requests for visitation. As far as giving him a chance to take custody, he was incarcerated at the time for domestic violence.
A little confused. He has been incarcerated for two years? Was he served for the TPR or the custody hearing? Maybe it doesn't matter if you can document that he knew about this arrangement since "day one." If he knew and did not contest your custody, did not request visitation, did not provide support, etc., it would seem that you have a pretty good case of abandonment. Your lawyer will know better how local courts usually deal with absentee fathers. Good luck.
