4 years abandonment and no attempt at contact the bio filed for modification of custody in prior state. We filed for TPR and step parent adoption in our new state. Bio fits the definition for abandonment (and could prove unfit, but didn't see that in the papers). Has anyone dealt with this over state lines? We made a motion to dismiss/make bios request pending until TPR heard. Has anyone gone through this? Did your prior state dismiss it so you could have TPR request take place in New state ?
