1. What percentage of your practice is dedicated to adoption?

If you prefer an attorney that only handles adoption cases, that’s perfectly fine. However, there are many qualified attorneys who also take on non-adoption clients. Asking a specific question about their percentage of adoption cases gives you a clear sense of their experience. 

2. How many adoptions like mine (e.g., independent, interstate) have you finalized in the last year?

Each type of adoption comes with its own set of laws and logistics for an attorney to handle. Ask your potential attorney about their specific experience with your type — whether it’s independent, agency, stepparent, interstate, or international. An attorney with recent, relevant experience will be better equipped to handle your case.

3. Are you a member of the American Academy of Adoption & Assisted Reproduction Attorneys (AAAA)?

It’s important for the attorney to be honest about potential challenges in your specific situation and explain how they plan to address them. Asking this question to each attorney you interview can also give you perspective and help you anticipate what to expect.

6. What is your fee structure (flat fee, hourly, retainer)? What is the estimated total cost?

Understanding the financial commitment upfront helps you plan and budget. Ask whether the attorney charges a flat fee or an hourly rate. Also, find out whether they require a retainer, which is a fee you pay immediately to secure their services. Finally, ask them to estimate the final cost, and whether they offer any types of payment plans. 

7. What expenses are included in your fee, and what will be extra?

Some attorneys include court filing fees, document preparation, and other costs in their fee. Others charge these separately. Make sure you understand what’s included and what additional expenses to expect.

8. Who will be my primary point of contact at your firm?

It’s important to know who to contact and what kind of support to expect. Sometimes you work directly with the attorney, but sometimes paralegals will be your main contact for questions and updates. 

9. How will you keep me updated on the progress of my case?

Good communication is important throughout the adoption process.  Ask how often you’ll receive updates and how the attorney prefers to communicate—by phone, email, or scheduled meetings. If you have a preferred method of communication, you may ask whether they can accommodate you. 

10. Can you provide references from former clients?
