I'm adopting my sister and BIL child that will be born in the spring. My sister is now talking about doing a legal guardianship or conservatorship, rather than a full adoption because she is afraid the child will lose access to "benefits" - presumably health insurance and/SS benefits.
I think this is just asking for trouble. I'll be a single parent, but I have a job with great security (college professor) so I really doubt that health insurance is going to be a problem.
She and her husband don't want to raise this child, but they want to help "support" it. Is there anyway to arrange this so that there is a full adoption but the child gets access to their "benefits"?
Anything other tha a full adoption gives them a right to reclaim the child at any time. The child can be covered by your benefits.
