:confused: My sons biological father has seen him 4 times in the two years he's been born. The biological father is into drugs, and has left the state to Indiana. I think its called disertion. But anyway, my husband has been around since the birth of my son and we have a daughter together. My husband has wanted to adopt him since the beginning but we dont know how to go about the process or if we are able to since the biological father wont let my husband. The problem is i dont know how to get a hold of him. What can or should i do?:(
I'm kind of in the same boat. My husband wants to adopt my son from a previous relationship. My x more than likely will put up a fight altho he lives in NY (we live in NM) and in the past 2 years has seen him once. It's a macho man thing. I wish you the best of luck.

It can be done without an Attorney, but MY recommendation is to consult an Attorney. The original consultation fee is usually free, and they can advise you on how to proceed with someone you can't find. I believe if they truly can't be found, that a Judge will have to terminate the fathers rights. (I THINK!, SO DON'T QUOTE ME ON THAT!)
My Husband just adopted my 14 year old son and the adoption was finalized on 5/1/07. We started the process in March, got the bio father to sign relinquishment papers, did our home study, hubby had to be fingerprinted and then we went to court to have the birth father's rights terminated and the adoption done at the same time.
