Example:
Illinois adopting couple
using California facilitator
for baby in yet another state (this particular example is Arkansas).
Whose laws apply? The state where the baby is ?
I have read that facilitators are not legal in Illinois.
Doesn't that just mean they cannot operate their office in Illinois?
An Illinois couple can still adopt using a facilitator from somewhere else , right?

To be safe, follow the laws of *all* the states involved.
If your laws aren't met, your state will not finalize the adoption.
If the baby's state laws aren't met, they won't release the baby to your custody (or your state will see those laws weren't met and won't finalize the adoption).
And of course the facilitator can't violate any laws of his own state.
You need an adoption lawyer for the adoption anyway, so find one who can tell you now if your state law is "facilitators cannot operate offices in this state" or "adopting couples in this state cannot use facilitators" or even something else.
