:confused: I am in the process of an independent adoption and, sought a lawyer for an initial consultation on what all I had to do legally. Now, I am being told that I HAVE to go through an agency. Does anyone know if this is true? Nothing I have read or researched has revealed this but now I am getting worried. Please help!!!
You have to have a completed homestudy (background check, references, social worker visit, etc.) in order to effect an adoption - private or public - which must be completed by an agency licensed by or in your state. This can take anywhere from 6 weeks to 6 months to complete. Hope this helps.

My wife and I are in the process of adopting in Texas. We started the process a couple of years ago with an agency but since then have matched independently with a ** and are now only using an attorney to handle the process.

Thanks for your response. What part of Texas are you in? I am in Dallas. Could you forward the contact information for your attorney? Is he telling you that you have to use an agency or only use him?

You have to use an agency and/or social worker to complete your Adoption Homestudy. However, once the homestudy is completed, you can match and accept placement independently, with the assistance of an attorney.
You will have to utilize the services of a social worker once again for your post placement visits.
There is no agency requirement for the State of Texas.
We don't live in texas anymore. We used to live in houston and that is where the attorney is. This birthmother fell into our laps because of a family friend that is a doctor.
But yes, you can use any social service agency that has licensed social workers that deal with this kind of situation to do your home study.
