Bio dad is in prison for drug related charges and hasn't laid eyes on my daughter in over ten years. no child support or anything. I have already took him to court once and changed my daughters name form his last name to my maiden name. he didn't respond to those court papers and didn't show up for court. i am now married and my husband wants to adopt my daughter. any thoughts? What rights does he have in prison? he isn't on the birth cert. either.

The bio father does have rights unless/until they are terminated. The fact that he hasn't had any contact in so long and isn't paying child support means that his rights could probably be terminated very easily due to 'abandonment'. Contact an attorney to see about the details but the costs shouldn't be very high for this kind of thing. Adoptions, when uncontested, are pretty simple (legally speaking).
