I have been married to my wife for 6 years. My stepson is 7. He has had NO contact with his bio father for 4+ years. We live in California. I want to adopt him. I have been in contact with the Bio father who is willing to sign the constent form IF the adoption is OPEN.
I have been in contact with a family attorney (with some adoption experience, but not his focus) who suggested this is OK IF we have a contract stipulating terms of the "openess". Has anyone heard of such a thing? Does anyone have examples?
He suggested I just write out a "contract" between bio and us stating what expectations we have if he wants to engage with our son. This sounds somewhat unofficial and don't want to make a mistake bringing this to court.

Can you ask the bio what he means by open? The last thing you want to do is give him more than he actually wanted. Start with that, and then see what you have to do. It looks like if he hasn't seen/talked with your son in 4 years, it probably won't be an issue anyway!
