I'm researching the laws for termination, and need to know what state we'll file in. We are legal residents of TX, but my current husband is military, so we live in KS. My divorce from my children's bio dad was done in TX. He has since moved to NC. So, do we file in KS, where we have lived for the last 8 months, or do we file in TX, our home of record? Thanks!!

If you meet the residency requirements for Kansas, you can file there. You'll need to find out if they have laws regarding the military...for example, in some states, if you are stationed there with the military, you are exempt from certain things...but you are also not allowed to do certain things. I believe when we were stationed in NC, they wouldn't allow my husband to adopt in their courts unless we owned property there.
You should be able to call the Circuit Court in your county and find out what the laws are...some states require you to be a resident for a year, while others have no resident requirement.
