Hi I am new here and I have a question for you. My Husband adopted my son in June! yaaaah it all went really well but we had to spend a lot of out of pocket to do so. So my question is do you know if we can claim any of it on the taxes this year? Any help would be great.
Tell me about it...we haven't gotten to the first hearing and already close to $10K so I already asked our CPA and the answer is no. You can only write off legal fees if they are incurred for the purpose of collecting income so if this involved a divorce and alimony/child support which is also considered part of your gross income, then it is deductible.

Yes started in December and it was done by June It would have been done sooner but we are overseas my husband is Military and had to wait to come back for court until he could get leave.
Our attorney told us we can claim the legal fee in the year the adoption was complete or one year after the fees were paid. In our case we were 90% thru the step parent adoption process in California and we found out we had to make a quick move across the country to NC with my husbands company. We lost out on over 5k, but were assured we could still claim it. Our accountant here in NC has already confirmed this. Look into it further. The only thing we have already been told we can not claim are the filing fees and what not.
hmm I will have to look in to it. It is just such a pain here because we only have the Military tax place and they don't open until the middle of Febuary. So if anyone knows how to do it let me know. we do our own taxes with Turbo Tax but I have not been able to find out anything with that.
