Ok I will try to stick to only the facts perintent to my question, we are trying to do a step parent adoption bio mom orginally asked for it but than she moved out of state (she hasnt seen our kids in 6 yrs) well we got a lawyer who sent copies of the adoption papers to her and her mother she called our lawyer and said she would only sign if we would forgive all her child support, so now the lawyer is saying even though she received them papers at her moms addresse which is the only one we have that we have to pay the state of az to serve her and she may not even accept service there, he is making us take care of it even though he has had our money all these months doing nothing, its 500.00 min for us to serve her which we have to pay out of pocket (the lawyers holding onto the money we gave him) than if they arent able to serve her we have to pay another 300 out of pocket to run an ad in the paper and we have to give the lawyer another thousand to ask the judge to allow us to serve her through the paper. He says they wont let us just run it in the paper first because we have to show the judge we made a good faith effort to serve her I think its crap because shes already proven she got the copy he mailed isnt that considered service? . Id he right that he cant just ask the judge to allow us to run an ad in the paper I am frustrated we have already given the lawyer 500.0o and we have done lal the work he isnt doing anything on the case when we call he just tells us to call and get her served if we want isnt that why we payed himble to serve her we have to give our lawyer

I am not sure what your question is. It sounds to me like your Lawyer is trying to save you money by letting you do the leg work. You need to have a process server serve her with the papers. I know that only costed us $35 in CA. Our Attorney had to mail the papers to the server and they served the BF. If after several attempts then you can run the add. You can't not accept service. If she opens the door the server only has to leave the papers. Whether that's at her feet or in her hand. She could avoid service by not answering the door however. You cannot mail the papers or deliver them yourself. I believe if you know someone willing to serve the papers for you that is not involved in the case you can do that too. That could save you money but you may want to check on that. I would ask him what the $500 went towards? It sounds to steep to be for the service of the papers. Maybe that was his retainer fee? You need to find out exactly what your Lawyer is charging you for. What his hourly rate is, and what you can do to save some money.
