Hi, I am new here and just found out a day ago I will be adopting a baby boy. My question is can the birth mother give up her rights before the baby is born? The problem is that she is in Oregon and we are in Idaho, so if there is anything I need to be there for in Oregon I would like to get it all done when we go to get the baby. I'm guessing that the adoption will take place in Idaho, is that right? ~TIA

A birthmom can not give up her rights before the baby is born. in most states they have to wait 72 hours before they sign. but in some states they can sign in 48 hours. the adoption should take place in Idaho since the birthmom lives there. in some states birth fathers can give up their rights before the baby is born. but I wouldnt advise a birthmom to let that happen because in case she decided to parent she wouldnt be able to get child support because he doesnt have rights anymore.
