Im a mother of 3 living in FL. currently married. I had 2 children out of wedlock in a previous relationship, in Oklahoma. The father is completley inactive his name is on the first birth certificate but he wasnt there for the second childs birth. I was told by the dept. of child support enforcement that he has no parental rights despite his signature on the birth cert. and in order to establish his right and enforce support they would have to do a paternity test. They have not been able to locate him, and as of yet i have recieved no financial support from him whatsoever. Im not entirely sure that what i was told has any validity with the adoption of my 2 older children. What im trying to figure out is how i go about getting started i dont know who to speak to, what forms to fill out, etc. if anyone has any advice i would appreciate it. thank you very much for the time.
The initial consultation with a lawyer is usually free. You can find out what it is that you need to do, and have in hand when it comes to the adoption process. Each state, and even county differs when it comes to adoption procedures.
If you are not able to locate the birth father, than you may need to do a public notice. THis is simply a notice that goes in the newspaper stating the intent for the adoption to go through. The biological father will have just over thirty days to see, and respond to the notice. If there is no response than the adoption process will continue as though he waived his rights to contest.
While the public notice adds a month to the adoption process, it is a small price to pay to know that an attempt was made to locate and notify the birth father, and that everything was done legally and to the letter.
You can also go to your local government webpage, many courts now have downloadable forms for common court cases so that you can print and fill them out at home, and then take them up to the courthouse. THis can greatly speed the process up. Calling your local court house can also be a great way to get started as they can tell you what forms will need to be signed, as well as what documentation you will need to have in order to complete a stepparent adoption

I had a child 5 yrs ago and the birth father has never ever seen the baby. I got married almost 4yrs ago and my husband is the only father that she knows. He wants to adopt her since the bio father never sighned the birth certificate my name is the only one on the certificate I did give her his last name. Does that make a difference? About 3 years ago I went to try to get child support and recieved a letter stating that they can't do anything because he never legally claimed her. D o I have to put an ad in the paper.I have never seen or heard from him from the time I told him I was pregnant. what do i do she already started school and thinks we all have the same last name my husband would like to do this soon.
If anyone has advise please let me know soon.
