I have a question. My husband and I live in South Carolina. His Ex-wife lives in Florida where the divorce and the case reside. The Ex-wife has given permission for me to adopt both of my step-children. We don't know how to start. Can we file the paperwork here in our state or do we have to file it in Florida because that is where the active case is? She said she just wants to sign the paperwork and be done with it? Any help or advice would be appreciated.

If you and the children have resided in SC for more than a year, than the adoption procedure should take place in SC. You will need to obtain Certified, sealed copies of your husband's divorce decree, as well as the custody agreement, if they were done seperately. Having a parent willingly sign over their parental rights is the fastest, and easiest way to complete a stepparent adoption. You can either obtain the documents online, or from the courthouse and fill them out yourself, or hire an lawyer to do the process for you. You will also need copies of your marriage certificate, as well as birth certificates for you, your dh, and the children involved in the adoption. check out the Stepparent Adoption Blog for more information!
