Hello all, I am new here and just looking for some advice. My husband and I have no children. We have the opportunity to adopt our nieces baby. I am looking for anyone who can tell me what all is involved in adopting a family members child. I have tried to look into our state laws but have not really been able to find a lot on the matter. We live in West Virginia. I will of course contact a lawyer eventually, but I thought maybe someone out there has been through something similar and could offer some advice. Thanks:)
For an adoption in West Virginia, both parents will need to legally terminate their parental rights in court. You will need a private adoption attorney to get you through the process. The link below will provide you with West Virginia adoption laws and answer many of your questions.

To adopt you have to have both bioparents rights terminated...then there's probably a waiting period for appeals...then you can adopt. Here in Florida the child has to be living with you at least 6 months before an adoption can finalize.
If both birthparents are in agreement to relinquish I would get an attorney. I'd also ask about counseling for the parents because you don't want them to make a decision without knowing what they are doing.
