So here's the situation. My fiance and I have a 13 year old son (he's mine from a previous relationship, but fiance is truly his emotional dad). His cousin asked us if we could raise her grandson. Her stepdaughter dropped him off at daycare and never returned. CPS has placed him in grandma's custody but she can't care for him long term. We would like to take guardianship of him and bring him home and then start the process of adoption. Is this doable? Or do we need to go through adoption before bringing him home? He's 1.5 years old and if we don't take guardianship soon-ish, he will go to foster care and that's not what we want for him. Advice is greatly appreciated. BTW, I'm in TX he's in West Virgina.
I would think you could take him. I dont know what the law is in West Virginia but I do know they want the kids to stay with a relative vs foster care if at all possible

I do not know the laws in your state, but my state would allow your family to take him if you live in the same state, pass a background check, and get a homestudy done. It might take a bit of time, but it is possible. Once termination of parental rights was done in court, then you can either take permanent custody and adopt when ever you like or adopt through the dept. If you live in a different state, then it is a bit more complicated but doable. Good luck, the red tape can be annoying at times, but it will get done if you stay on top of things.
