I brought him here to Arizona on an IR2 visa. He has a green card. The adoption was completed just last week. I will request his name changed on his social security card, and his state ID.
I am confused about the Child Citizen Act of 2000.
He is presently 15. I am his adoptive father and I am a US citizen by birth and a Veteran. His mother is not a US Citizen, but she is also here on a green card.
The rules follow:
1. Have at least one U.S. citizen parent by birth or naturalization !?!
2. Be admitted to the United States as an immigrant for lawful permanent residence
3. After admission to the United States, reside in the country in the legal and physical custody of a U.S. citizen parent
4. If the child is adopted, his or her adoption must be full and final so that the adoption process is legally complete and fully recognized by the U.S. state where the child is residing.
The ambiguity resides in item #1 and #3. I am his adopted father, so do I count?
What form do I need? Can I start it now? We are still waiting on his birth certificate.
