My husband and I are in the beginning stages of a private adoption. 11 years ago, my husband had a felony assult that was dropped to a misdemeanor. We were going to do fost-adopt through our state, but since his actual paperwork came through the license office after jan 1 2003, we were not approved for fost-adopt. If it would have been processed earlier, we would have been approved. Now we are in the beginning of this private adoption process and I am wondering if the same stipulations will apply in this case. The mom will adopt to no one else and said she would just abandon the child--we would take it even without legal adoption to avoid harm. We are also submitting paperwork to get this expunged from his record. Is private adoption even going to be an option if this is not removed from his record or does it matter? Most agencies do not hold approval of an adoptive party for an incident that occurred in the past - provided you identify it upfront to them and all of the circumstances and can get those circumstances verified. They will make note in your homestudy that the situation occurred and what corrective action followed ... including your current activity regarding getting it expunged. All of this is, of course, pertinent on the felony - now misdemeanor - did not include a situation that would be dangerous to the child being placed (i.e. - sexual predator).
