My husband adopted our two oldest children 7 years ago. My former husband, the biological father, had been gone since the children were 3 weeks and 20 months and we had had no contact with him in those years. He was serving time in prision when the adoption went through. Now, when the children are 14 and 12, he is seeking some involvment in their lives and my husband and I are concerned what impact this could have on our children. Our attorney does not believe he could gain any visitation rights with them unless he can prove he did not know of the adoption proceedings. As I said, he was in prision and I assumed that while in custody, they could easily serve him. I trust in our attorney however, this is not something he deals with very often and has told me to research this matter. Do you think that my former husband, who abandoned his family, paid child support only a few months, has a prior history of drug use and past criminal record, could obtain visitation rights with my children?
