we have had our son in our custody since the day he was born! june 2003.
we are adopting from PA and the adoption is a closed private adoption.
b/m rights were terminated in March 2003.
and we are about to have our 3rd hearing for the b/f. he is served with papers telling him of the hearing to terminate his rights and he has signed the necessary papers to have his rights terminated. both b/m and b/f have shown no interest in coming to the hearings and haven't.
we are so frustrated! when we talk to our lawyer he tells us the court is backed up and all sorts of other excuses etc... our son is 14 1/2 months and our adoption is NOT final. oh and our lawyer has been paid for about 7 months now.
should we seek new counsel??? i am desperate for advice but mostly to have our adoption final. please help..... :(
See if you can file the petition in a different county. The county I live in always has a full docket, but the adjacent county doesn't. I filed both of my sons' petitions and was in court the next week.

How could the birthmom's rights be terminated prior to the birth? I don't think it is your lawyer giving excuses. Adoptions take a long time to get scheduled due to paper work and SW visits and such. We were notified 6 weeks prior to finalization that all the paper work was done, but that we couldn't get on the docit until such and so time.
Good Luck!
