Hi am new here. My husband is adoption my son who is 13 in the state of CA. It is being contested after finding the birth father after 12 years of abandoment. We are attempting to get him to consent but he wants us to let my son see a letter that he has written before my son consents ( this letter is full of untruths that can be proven). My son has already meet with his atty. independently and consented to the adoption.
I am looking for any case law or precendents like this before. We feel we are totally within the law. I have always had sole custody and the child has consented and been informed by his atty that he Bio is fighting it and loves him (gag Sorry!).
Any help would be great. We both have atty's. I have a lidigation one and general and he has his own.

Your son is old enough to have his say about the adoption carry quite a bit of weight. I wouldn't worry about it.
You ex does not have to consent. After this long of an abandonment he doesn't have a chance in court.
