We are an American+Brazilian couple living in the United States that is interested in adopting a Brazilian niece.
Is it possible to adopt a niece and what is the process? As my wife is a Brazilian citizen and already has a history with the child (I have met the child also), does that make a difference?

You only can adopt any person in Brazil who is an orphan. It means that his/hers parents had surrended all their rights as parents to the government and the child (up to 16 years old I think) is under the custody of CEJA (State Commission of Judicial Adoption).

I think you can adopt your niece here in the states. It is not the adoption that is the problem but the visa to enter the US. I am thinking you would use a different visa than the adoption one. Check with INS. My guess is you would adopt your niece in Brazil and then petition to have her enter the US as a family member. If you go to INS webpages you can look at the different visa's to bring family members into the US. Then I think, once a child (or maybe any minor) lives with you for so long, you can apply for permanent status?? Something like that. Check with INS. I don't think it would be that difficult.
