While filling out the paperwork I noticed the requirement that the birth parent, if out of state, must sign a consent before a notary. Our problem is that we have no idea where he is. I have had no contact for more than 10 years. My husband has been financially and emotionally responsible since our son was 2. What prove will I need to provided so that my husband can adopt our son?
Make a log of everything you have done to try and make contact. Online searches, last known addresses, trying to contact his family members or friends. If none of this turns up the ex then you will have to go to court to request notice by publication. Look it up its in the CA Code of Civil Procedure. A judge must approve of giving the notice this way, that is why you need a log of the dilligent search you made to provide to the court. The notice by publication is made in a newspaper in the city of his last known address. It has to run for 4 consecutive weeks. Read the CA law and you'll know more.

Contact the step parent adoption Social Worker in your county. They will be able to let you know what kind of searches your county requires you to do. Mine only requires asking friends and family. And newspaper search. Let my know if you want the number to The Daily Journal in L.A. They do searches for only $45.
