I am wondering if we could still get a tax credit if we're using a surogate. We have already put in 5000 to an agency that we probaly won't get back if we use the surrogate. Can we get this back through the credit? Also, does using a surrogate apply still as an adoption, therefore a credit? (It would be her egg so it would be like a step parent adoption for me). Thanks.
Go to the IRS website and view publication 968, which discusses the adoption tax credit. Under "non-qualifying expenses", on page two, it says that expenses cannot be counted if they were for "carrying out any surrogate parenting arrangement."
