I am an adoptee in the state of Illinois intending on petitioning the courts for opening my birth record and am in the process of putting the case together.
I am not a lawyer, however I successfully completed my divorce within the Cook County system and was successful, despite the judge's resistance to our having 2 young sons.
With this in mind, I viewed on another web site the argument set forth that a Bill of Attainder (an adoption decree) is in direct violation of the 9th amendment, along with the use of Amendment IV in that people have the right to be secure in their person against unreasonable search and seizure of "effects," which would cover any and all biological information pertaining to the adoptee. Both subvert an adoptees right to due process and due to the uniqueness of my situation, I believe it to be vitally important to my case.
I am wondering if anyone has any links to any web sites with information regarding any adoptee's success in representing themselves and/or other cases that have set precedence using this argument. I am new to this aspect of law so any guidance would be greatly appreciated!
