Hello, I am a bmom and have had some issues with that one. Is reality, there is not a difference, you can claim a child on your income taxes regardless as long as they live with you for 6+ months during the year. I have a step-son and the man that I am married to is not his bfather, yet we have guardianship. We are essentially his parents, we were not given custody by his mother, but we were given guardianship. It is basically the same as long as the child lives in your home. I do not know if this is true throughout the US, but it is true in Texas.
