My girlfriend is 16 years old and is pregnant. I am 18. She is due on october 14, 2004. She doesn't turn 17 until December 24,2004. I turn 19 on November 4, 2004. What i am trying to find out is who will have custody of the baby. Her mother claims she will have partial custody, but i have heard otherwise. The mother also claims she can press stagutory rape charges on me. My girlfriend and i plan on getting married, even if we must wait until she is 17. Which brings me to my next question. Her step-father is in jail and her mom may not sign the marraige papers. Can her biological father or someone else sign them. Thanks for any help.!!!!! I need it.
Being 2.5 years apart, I don't think most states would get you on statutory rape charges. I also don't think the most reasonable answer is to get married. You owe support to your baby, but marriage is NOT necessarily the answer. Wait until you're both a bit older. Your girlfriend and yourself will have custody of your child initially. Her father can sign the papers, but seriously consider if this is what you want!

Please go to legal aid and see if they can help you. In MI they can, and often do press statutory rape charges, even when it is consentual. However there are many states that are far more lenient.
As far as marriage, in many states giving birth automatically emancipates minors. Her mother will not have a whole lot to say about anything if this is the case.
However, remember that this woman is your baby's grandmother, and, if you get married, she will be your mother-in-law. Consider family counseling so that both of you can understand the other's point of view. Don't put your baby and your girlfriend in the middle of this.
