I would check the INS web site and talk to a tax advisor. We had a failed adoption due to a scamming agency and may be able to take a credit using the Atty generals office from the state the agency is located in.
There may be a way to claim it, you just have to locate the right loop hole...
First, my sincere thoughts are with you on this failed adoption. I can only imagine the emotions your family must be experieincing.
As for your question, I know that when we filed our taxes and claimed the tax credit, we had to give our sons' social security numbers. And since you won't have one to give, I don't see how you can claim it.
But checking with hockeymom's suggestion is a good idea. I'd also contact the Adoption Tax Credit specialist with the IRS, too.

We just came home on Sept. 10 th with no children after 2 appointments with the NAC. I have checked into the tax credit and it is for failed domestic only. I am developing a petition to Congress for those of us who have had failed international adoptions (especially from Ukraine). Please let me know if you or any one you know would be interested in signing such a petition. Are there any groups out there who know of other failed international adoptions maybe they could help as well. Alexandra

I agree that there should be some compensation for failed international adoptions...
My friend from Tx was scammed by an agency also....however, she did get back her $$$..........(exception to the rule)......I'm not sure what she did to accomplish her mission....
this particular agency closed....and emerged under a new name(s :eek: )...........and they are baiting people again.....

Do you have a link where people can click on it and sign the petition? I think even people who have not had a failed adoption would happily sign this petition. You should post this on the general support area of this board as well as on the frua board, the yahoo boards, etc.. Get it out to as many adoptive parents sights as you can. I bet everyone will sign it!! Thanks!!
Yes, I would sign the petition. I just paid off a big loan on a failed Kazakhstan adoption. I think there must be a lot of folks out there who went overseas for a child and returned with empty arms. We are pursuing an adoption from the state, as we have don't have any funds or stamina for another international adoption attempt.

...it' s probably the most efficient way to reach people and I'm sure the response would be incredible!!!
....those of you who've had a failed adoption....my heart goes out to you!!!! There are so many things that can go wrong....so much depends on the facilitators...However, the real tragedy is that children are not being adopted out to caring and loving homes...they face a bleak future.....this is CRIMINAL.... :mad:

I would sign your petition. I'd suggest putting it in the General Adoption section of the International Adoption board though. I don't know why I'm even in the Ukraine section right now--just kind of websurfing a bit, so it's totally random that I even found this thread. We had a successful adoption from Ethiopia, but again--I'd be happy to sign the petition. I see no reason why people who attempt to adopt within the US are somehow more worthy of a return on their money than those attempting to adopt from abroad.
