I have a unique situtation. I am in my mid thirties, my husband is in his early seventies. We are really wanting to adopt, but I am hesitant to pay agency application fees if they are not going to accept us. Any one else have a similar experience, or any insight that may help?
Most agencies have an orientation you can attend for their different programs (internation, domestic, waiting child, etc). I'd attend one of those and ask if they have age restrictions. Many international programs do, and it is the country itself that sets these rules. With domestic and waiting child, it is usually the agency who set the rules. Some do, some do not.

I don't have much info on this, but I do know that if you adopt privately (through an adoption attorney), you may run into less of a problem. My husband and I were both 51 when we adopted for the first time. The attorney who handled the adoption told us that she has handled adoptions for much older parents. (If you want her name, PM me.)
By the way, one of my favorite people, a former boss, had exactly the same age difference with her husband. They adopted two children--one from the state of Florida and the other in a private adoption.
Best of luck.
