My son hasn't seen his bio-father in about 8 yrs. He wanted nothing to do with us. I have looked for him everywhere. I went to his old neighborhood and he never showed up at my families house. My husband and I have been together for 9 yrs and have been married for almost 6yrs. We have 4 other children together. My son will be 13 in july. We want to proceed with adoption. Would we be able to file under abandondment?
You can file under abandonement and many other fam law codes, yet all you have to do is file to get the ball rolling. I know in my county the social worker that does the investigation determines what law to file under.Other Counties I am not sure of. Technically abandonement is no contact or no support for 1 year. It is only one year in the state of california. So you can file for the adoption, also your son is going to have to consent to the adoption also, so be sure he is aware of the situation.

You are going to file the paper work. I know at our court house we have a packet we can pick up. So I would go to the court house and ask them about the paper work. Also if you read through some previous threads there are some links to differant websites that yeild the paperwork. OK here is probably the surprising aspect. The adoption is taken care of through the PRobate department. So go to the local clerks office for the probate dept. See if they have the paper work. The only problem is that the paper work has to be filled out correctly and so you really need to investigate how it is filled out. Also on the computer. So your first step is to fill out the paper work. You can either get it off of websites or you may be able to get it from the court. Once again I encourage you to read other threads. There is one thread not too many before this one that the lady also is in LA county and a person gave her a couple of websites to refer to. you can click on the websites that are a differant color and it should direct you there.
