I posted [URL=http://forums.adoption.com/showthread.php?t=166676]this[/URL] awhile ago and wanted to provide a little update and receive some feedback.
Summary of the article is:
Donor hasn't seen his daughters (10 &7) in almost 4 years and hasn't contacted them in 3 years. He still pays child support but only because it is state mandated and automatically removed from his paycheck. I have been the the only father figure in the past 3 years.
Here is the update:
We spoke to the social worker and everything went well. She sent a termination request to the donor. He called the social worker and he refused to consent to the adoption. He freely admitted to not having any contact with the girls since 2001. He also admitted that the only reason he pays child support is because of the court order. He claims that we have not allowed him to see the girls. This is not true, we refused to allow his sister to come pick the girls up, but we never told him that he could not pick them up. When the social worker asked if he took any legal action he became very angry and said that he hadn't.
We should be receiving the social worker's report soon and will file the abandonment paperwork shortly after. Then we will be serving him. We know with about 99.9% certainty that he will not show up to the hearing.
To myself and my wife, the conversation the donor had with the social worker seems to look favorably on our case. However, because we have emotions and hope tied into this case, our outlook maybe (and probably is) biased. I was wondering if this looks good to people on the outside.

It sounds good to me. basically what the social worker uncovers is the basis for the termination. So if she uncovered and found it to be true on the whole abandonement thing you have a good case. I hope it does all come together for you. We have not gotten that far but our attorney has advised us that whether he shows up at the hearing or not the judge pretty much has their minds made up unless you get a newer judge. Let us know what happens and I hope all goes well.
PS Watch using the word "donor" some of us got in trouble for using it a few weeks back.
