tax deduction for failed birth parent expenses

Does anyone knoe wether we can we use our birthparent expenses for a failed adoption as a tax deduction - based as a donation to our agency. We gave the money to our agency (non-profit), and then they paid the expenses. When we adopted our first child, that agency said we could do this. We want to save the $10000 for our next adoption. thanks Steve
