My Husband has been wanting to adopt my Son (Daddy since he was 3 years old!). The "BioDad" has recently passed away...which takes aways the whole Parental Rights issue...WHAT NOW???

You file the necessary paperwork with a certified copy of the bio father's death certificate. The stepparent adoption should go through as quickly as one that had consent.

Call your local superior court and find out which branch handles adoptions. That is where you go to pick up the forms and file.
