In Missouri, how long does a birthparent have to appeal a TPR order? If they appeal it, can the appeals court deny hearing it based on insufficient evidence? If this happens, what kind of time frame does that take?
We have TPR hearing in two days. Some people in this case feel mom will appeal and others are unsure. She has no substantial evidence to appeal, but is defiant in nature and would do it just to be spiteful.
Can someone answer these questions for me?

Mom can't appeal until the judge renders his/her verdict. If TPR is granted then mom has 30 days to appeal. In our case it took several weeks to get a verdict. Once she appeals, then it will move onto the appellate court which could take several months to hear. One of my foster parent friends is going through this now. The TPR was appealed in February and still hasn't been heard by the appeals court yet. She was told it could take up to a year. And then if TPR is appealed through the appeals court it will move to the supreme court where it could take another year. However I don't think the state pays for mom's attorney to appeal to the supreme court. But I'm not 100% for sure on that. If that's the case maybe mom won't appeal. We thought birthmom would appeal ours but she didn't hopefully that will be your case too! Good Luck! I'll be saying a prayer for you.

I just got a call today and the mother's atty has requested a continuance of at least 30 days because mom is at a 30 day inpatient drug rehab. I am just stunned and heart broken. I so badly want this over with and I have a feeling it's not going to be over with for a long time. Our Juv. Officer said this is a very normal thing and almost always the first continuance is granted but just cause must be shown and documented before another continuance is granted. I am trying to just leave it in God's hands, but it is so hard!
