Hello,
we started with the adoption process three weeks ago and matched already. We work with a non licensed agency they only connect adoptive parents with the birthmom. They said that we need an attorney and the Birthmom needs an attorney. They also said that we can work with an attorney in North Carolina.
I do not really know anything. How does it work after we have the baby in our arms. Do we contact the attorney after or before it? What kind of papers do we need? Is the attorney contacting the birthmom's attorney. We do not have any clue. The baby is due in November and the mom lives in Virginia. I am thankful for any advise:-)

I live in NC as well. I have been involved in the process of adopting since January. First, congratulations on being matched. However, I must caution you on not having a licensed agency to work with. I am happy to help you with your process - in terms of finding and attorney in NC and what not, just PM me and I would be happy to help as well as find out more about your situation!
Cheers-

I would agree with Georgia, there are some issues here that are of concern.1. It's illegal in Virgina for anyone - licensed or otherwise - to receive payment for connecting expectant and potential adoptive parents. This includes 'facilitators', 'networking agencies', etc. This CAN jeopardize the legality of the adoption even if you're not a resident of Virginia because the child and mother are. Anyone who tells you how to 'get around' this well known law (vis a vis "donation" or making it a "birth mom expense") does NOT have your best interests at heart. 2. You should absolutely only be working with licensed professionals. They can explain the complexities of inter-state adoption, can provide you with your homestudy, post-placement supervision, and ICPC needs. You'll need an attorney experienced in adoption (check the member listing of the American Academy of Adoption Attorneys for names) in BOTH states to negotiate TPR, ICPC, and finalization. Here's how it works:When the child is born, your Virginia attorney will follow the laws in that state to complete voluntary TPR for both biological parents. Once this is done, your Virginia attorney then initiates proceedings through ICPC to have the adoption proceedings transferred to your state. You'll need a receiving attorney and agency, who will then supervise the adoption for the legally required period, then file for finalization in your home state. If this baby is going to be born in Southeastern VA, I'm happy to recommend the attorney we used - just PM me. Take care,Regina
