I have a daughter from a previous relationship. Her birth father has not seen or contacted her in 3 1/2 years and he has not paid support for her in at least 5. My husband would like to adopt her. She also would like him to adopt her. Here is my big question. When I had her I lived in a different county and all court processes have gone through that county. When I decided to get married I went to court and her father agreed to us moving to a different county. Since our entire court history has been in the other county is that where we have to start or can we start in the county we now reside in? Does anybody know the answer? I have tried many different avenues to find this answer and nobody can seem to help. Any information would be helpful.
First you need to find a lawer that specializes in adoptions or family law. Sometimes if you call thier offices they could give you the answer for free. But either way, you will still have to have a lawyer in this field to file all your nessasery legal papers, for the adoption. Also if the "bio" father has not made contact with her. he is given a chance to fight the adoption, usually a post will be put in the local paper that he has so many days to file a petition against it, if he does not reply in that time frame, the court will reevaluate the adoption and it likely be granted!
