I have been trying to find out some info. My SIL joined the Army back in March she did this thinking she would be able to run from her problems and now I am facing a problem. This is a long story so bear with me. My nephew and his half siblings were removed from their parents in Nov.06 for neglect and abuse. My BIL ended up in jail for 252 days for the abuse of the children and mother was found by CPS of failure to protect her children. The older 3 children were sent to live with their dad in another state but we got our nephew. He was 4 months old and was very sick he was sleeping in a room with no heat and ended up with MRSA phnemonia and died 3 times. He was lifeflighted and was given 5% chance of living while we sat with him at the hospital his mother never came to see him and never called even though I gave her the 1800 number to the hospital. We brought him home in Dec. right before christmas last year. He is now very healthy and happy. But his mother decided instead of doing her case plan as she was ordered to do by the judge she went to boot camp. So a few months ago we found out the children were sexually abused as well. We are waiting on criminal charges on bio dad. Mom was back on leave a month ago and said give him to his dad I cant have him with me and I dont want anymore to do with this. Well they are telling us we cant adopt him because of the Soldiers Relief Act they cant take her parental rights away. I have read the act and as far as I can tell she isnt cover because 1 this started before she entered the Army it says it will not cover anything that is ongoing and started before enlistment. And 2 from what I read it is to cover them when they are deployed and unable to attend court. She will be stateside till April and we are due in court the end of Jan. If she is called back for court will her CO make her come? And does anyone know is she covered? I want to go into our next meeting with CPS lawyers armed with info and even though my Grandfather was a career Marine he has passed and I cant ask him. And my baby brother started West Point this year. These are my military experiences so I am Limited to put it mildly. Thank you for any help you can offer.
