In October 2008, my son's birthparents thought of placing his bio sister for adoption with me. I contacted an adoption attorney and started the process of an independent adoption. Right at the end, the birthparents regretted their decision and took the baby back. :(
I had a significant amount of expenses (~4,000) during this failed adoption experience and I think I should be able to claim them on my taxes. Can I claim these expenses on 2008 or on 2009?

Yes you are able to claim expenses for any failed domestic adoption. One thing you have to remember is this Child #1 of your adoption credit is any child you have attempted to adopt, up until you have a successful adoption.
Examplem we were in the process of adopting, and had a child for 4 months...then the adoption failed. We now have adopted and finalized, both children's expenses are considered 1. So it wasn't like we could use a adoption credit for child 1 and turn around and get another one for the son we have now.
