We have recieved a 36 page agreement/contract from the agency we have decided to use and I was wondering if anyone found it necessary to run this type of agreement past a lawyer? I'm sure its a pretty standard contract and much of it relates to the Hague Convention, but I was just curious if others found value in having a legal review of it.
Thanks.
We didn't have our contract reviewed, but I would totally understand if you did! It is a long and multi-faceted agreement and when both parties sign it you will be bound by its terms. If you have any hesitation or confusion, it would be a good idea to have someone review it.
We didn't have ours reviewed mostly because I am a lawyer and I read it with a fine tooth comb. I don't specialize in anything close to adoption, let alone international adoption, and considered having someone else review it too. But I got to a level where I was comfortable with it.
I will say this, whatever you decide - read it very very closely. Read every paragraph and every word and really understand it. If your agency later wants to revise terms, you will want to feel grounded in what you previously agreed to. International fees can change mid-stream, they did for us and every contract will provide for that possibility.
Also, if there is something that you think is vague or needs clarification in the contract, I wouldn't hesitate to ask your agency about it. They may be able to change a little of the language to accurately reflect what you both believe your agreement to be.
I found this initial contract (that had like 15 places to be notarized) to be one of the most annoying paperwork parts. Once you are done with this one, you will be on your way! My best to you in finalizing your contract and getting the process going!
