Ok so someone tell me-- since the judge put a halt to DCS reducing our rates, do we go ahead and file January's per diem w/ the old rate or the new one??
Also- it seems someone forgot to tell the state that they were not allowed to reduce the adoption subsidy. I just received my email stating my adoption subsidy would be deposited on Feb. 1 & it's the reduced amount AGAIN!! GRRR

I just got the email for the adoption subsidy and they are still taking the 10% out of the payment. It says that it will be deposited on the 1st.
go to iarcca web site and you can read the actual court order from the judge state was ordered to go back to 2009 rates for adoption and foster effective january 2010 . There hands are tied right now About time they get told how it is going to be . no more cutting rates from county to county either.
I am going to assume that the adoption payments will go back to the full rate in March. The reason being that the judge ordered this on Jan 26th and Dcs will say that it was "too late" to make any changes for the month of Feb.
Again, it's just my opinion on why it hasn't gone back to regular payments for adoption.
No the order clearly states it is effective january 1st 2010. They have to go back to the first or they are going against federal court order.

I understand that the order states effective January 1st. However, with the adoption payments January payment is for January unlike foster care payments which January is actually for December.
The judge did not order this until January 26th so the payments for adoption subsidy already went out.
I read on another board that someone had called Indy and they said that the adoption payments are automatically in the system and they are having to go in and change them one at a time (whether or not this is true who knows) and that March payment will be without the 10% reduction.
Who knows when they will reimburse us of our cut that we have taken for Jan & Feb though.
I'M sure they will get it done in timely fashion because this is suppose to go to trial in febuary for final ruling . They are going to be watched closley by aclu and iarrca on this stuff between now and then. I think that iarrca will win this suit after reading the judges injunction order. The judge did not side with the state on any issue in the case .
Got the letter about adoption subsidy today. It doesn't go back to the old rate until March 1st. Sometime in late Feb or early Mar. a retroactive adjustment will come.
As for the per diem, I don't know. Has anyone asked their case manager?
I received the full amount for January's adoption subsidy... does this mean I'll be seeing the 10% cut in February's subsidy?
Also can someone tell me if Michelle Saveio is still the contact person for Allen County?

That's what I plan to do. Since the the judge clearly included per diems in the hold on cut-backs, I believe we can file our January invoice with the '09 rate.
Just wanted to add that I recieved my AS yesterday with the full amount. I did recieve the initial letter giving notice of the cutbacks but have yet to see it reflect my AS. I hope it stays that way and god willing - those who have seen the 10% cut will see some kind of retro payment soon!
So what do we do if we didn't find this information out until after we filed our claim? I filed mine this morning via fax and then read this just this afternoon. I guess I should have been paying more attention to the issue, because I hadn't heard anything about it since the first letter.

If I were you, I'd call your local office where you faxed the claim to and ask if it's too late to file a revised one.
If it's too late, you will be paid back for the difference, but it might be a month or two.
I think it's interesting that the state was quick to send out letters informing us of rate cuts, but haven't done a real good job of making us aware of the injunction.
If it wasn't for the alert foster moms on here who alerted us, most of us would be filing invoices with the reduced rates.
