I've being married to my husband for almost 9 years, my child was 9 months when we got married. He is being there for her since and support her 100% on everything. a year and a half ago she told us that she wanted to have my husband's last name. Her bio-father has only seeing her three or four times when she was born he went to the hospital to give her his last name and got busy making his life and only came around when his family push him to see his child. I was about to file for child support when him and his wife beg me not to and that we could fix it by talking instead of taking it to court, then i realize that i was basically forcing him to be a father. Now a week ago we file for termination and adoption process and when that was file we call him to meet up and gave him the termination forms that he need it to sign he had a surpise face and only told us that he was going to revise the forms and also speak to an advisor if need it. I am so excited but nervous at the same time because we have not heard from him I don't know what he is going to do next, my child can wait to have my husban'd last name. My question what if he does not sign? Do we have to go to trial and make my child go yo court just because of his ego?

It's not often that a court will terminate a parent's rights if there is no abuse, neglect etc. If your ex doesn't want to relinquish his parental rights then the courts would need a true valid reason to do so. Not paying child support isn't a reason and the courts would rather enforce a support order than terminate a parent's rights I think.Hopefully others have more insight for you...
