We adopted our over 2 foster child earlier this year, and already, the process has changed!
We're adopting our 18-month-old foster son now. We had been told that AAP was based entirely on age (at least in IN). Since he isn't 2, he wouldn't receive any. So, we were wanting to delay until he's 2 since it's not that far away. However, our county wants it done by this fall, and our cw said that AAP is also based on whether or not he was "deprived" at birth by both of his birth parents, which he wasn't.
Does anyone know about this or has anyone adopted an almost 2 year old?

maybe I said that wrong.. Mine was NOT deprived either.. that is why no federal.. just state,what I meant was that you would NOT qualify for IV-E without deprivation. but You very well may for state.. at least medicaid and NRAE probably waitlisted for any monthly subsidy. Just dont let the state tell you they arent eligible . THEY DO NOT HAVE TO BE 2 YEARS OLD. Those requiremenst specifically state 2 OR MEDICAL NEEDS.
I have all the paperwork I ever filled out.. all the emails I ever sent and recieved from anyone in Indy.. In my county.. from my attorney.. all of it..
Lori - is that what i am understanding? That you cannot get federal if the child is not deprived or do you mean if they are under 2 they can't get federal if not deprived?? Sorry, this shouldn't be such a confusing subject but it always is, huh?!

federal regulations state that the child must be deprived opf parental support to qualify. So the derpivation factor is the deal breaker. Not the age.
I told CW( not that its worth anything) that I hadnt thought that a parent who was a 7-11 clerk at minimum wage who had lived with the other parent for less than 2 weeks. ( actually lived together) and the other parents profession was dealing prescription drugs from the trunk of a car , should be considered to be able to provide parental support. The fact that they were together was a big issue. I dont know your exact circumstances but if your bio was a single mom... that may be able to qualify for deprivation. there are alot of factors that are weighed into it.
CeCe,, I am not near Indy.. unfortunatley.. I am in South Bend.. it is an easy shot from here though and I would be willling to meet half way if your interested. I feel like I am not alot of help to many others.. and I cant be licensed for more foster kids now.. but I do keep trying to think of ways to help someone.. even if its just with what I have learned. It is fairly easy to research.. just takes some time. I found it easier to get black and white info regarding TPR and everything before the adoption process.. there are alot of gray areas. I know that depending on alot of things.. all our cases can go totally different ways. But I was always searching for someone that had as close to my story as I could find to pick their brains.. if your interested PM me and we can work something out.

yep.. that too.. but I must stress that in my case.. the CW was not full of alot of worthy info. once we got to the deprivation issue ( the only issue really) it was a question of the parents being together. actually living in a household as a family .. if you can call it that. I ended up supplying them with documents that had move in dates and such. It was an attempt to try showing that it wasnt like there was a family unit.. again.. if you can call it that.. for more than 1 week...therefore income limits of just mom would apply. at least for the past 30 days.. or whatever the time frame was for the AFDC rule. didnt work though. it was worth a shot. And DCS , in my experience of course, just takes things for granted..just like his case file.. they barely had anything in it. one reason I was told was because I WAS the g-ma.. and I knew more about family history than they would.. uhh hello?? That means they dont have to keep as good of records had I been someone else. Im a little bitter by the things that have happened. And what I had to initiate and supply to them.. I think alot of it was my particular case worker.. on top of not being assigned an adoption worker.. alot of things went on that I could never begin to explain without an actual conversation. ian on aeemupttht md.i. k

To be eligible for federal (title IV-E), the child must be AFDC (deprivation) or SSI (significant disability like Down's Syndrome) eligible. So, age doesn't matter.
Your cw can tell you if the child was considered "deprived".
Ok I want in on this meeting you guys have to pick Lori1001's brain! Lol!My cw was out today. We were talking subsidy again.. She says yes they definitely are IV-E eligible but yes we have to negotiate.. I told her fine, I want a raise.. ha.. In reality, do we have any say in the negotiation or is it just the atty's?

i know for me, i am going along with my atty to meet with the dcs atty. if its marion county, i posted something a little while back that my attys said dcs atty has been using in the way of determining subsidy.
we have to get this done before the 26th because that's when my tentative finalization date is going to be. i'm keeping my fingers crossed that all goes well for both the meeting and getting the date.
I would love for us all to meet! wouldnt that be fun!?

I know when I was searching for info.. I always had to remind myself that what happened in one case in no way means it is a given for mine. It was just something I felt I had to keep researching. I think it all did help when or if I had something I believed should be the way it went for us, and it wasnt going that way. I could at least question it. sometimes I was right ( that was usually with trivial issues) other times they were amazed that I even knew of whatever the topic was at the time. I dont have any knowledge of the negotiations for IV-E subsidy. I only know why we didnt qualify and what the guidelines are. which is easy for anyone to find. I know our state subsidy ( that we were waitlisted for) was negotiated by my atty and DCS atty. That was done in the court hall minutes before the finalization hearing. I wasnt even a part of it. I was very suprised to see that the max rate or 18.75 was on the agreement though. As I had heard that those had dropped to 4.00 for some. I believe Ice Kittty was the one that mentioned that in another rescent post. But Im thinking now she must have been referring ot federal. Any way.. Im game with whoever else is.. and I dont have a real tight weekend schedule ( any more woot woot!) however I wouldnt be able to do this until the 3rd weekend of this month.. or any time after.
Im excited with the thought "ROADTRIP" I say we need to make this happen, instead of just talking about it and letting it fall by the way side!!

We are from Texas so a two hour drive is nothing for me. We used to go that far for good sushi.
I would have to do it on a weekend.. saturdays are best. are we bringing the lil' ones along? I had originally figrued I would be bringing him. But then wondered how much chatting would that allow? But could be a play date as well. I have no problem with kokomo or ft wayne. But I wonder if there is a nice park that we could possibly go to in either area. The kids could run and play and we can find a nice picnic table? of course a back up plan in case it is raining, or 112 degrees out would be great to. wow.. there is alot to think about. I dont know either area very well. I have traveled through both, but thats about it. The only thing holding me up is a new roof on my garage. I was aiming to have it done this coming weekend. but I just heard the weather report nad they are saying hot. I could tell them the following weekend though. Ill await you're thoughts to arrange my plans . Im flexible with either. in the mean time lets do some research and thinking on where and all that??
also .. is there any one else interested before we move this to a private session??
