Hello!
My husband and I are in the process of our home study. The agency we're planning on using for the actual adoption (different one than the one for the home study) apparently matches adoptive parents with birthmothers even before they're homestudy-approved. Is this legal? We need advice.

I'm not sure, but I'd REALLY question that! My DH and I have been waiting with a completed homestudy for over a year. Most people on this site have been waiting for several months at the least and several years at the most. My mantra is that if it sounds too good to be true then it is. Why do they need to give babies to couples who haven't completed their homestudies? When they have so many couples who have? Sounds like a gimmic to me. Good luck!

I think it depends on the situation, but I'm still surprised they mentioned it to you.When we adopted our first, International was still big and there weren't very many adoptive couples without children. We suspect they were showing our profile before our homestudy was complete since we were matched just a couple of weeks after it was, but we never confirmed it.My guess is that if an expectant mother hasn't found a couple she likes from the profiles currently available, the agency might show some profiles of people currently going through the homestudy.
There isn't anything illegal about matching before your homestudy is done. If they don't have another family the birthparents like, then you might be shown. However, you will need to have the homestudy done before the baby is born or at least before placement. You might want to see how early they are matching you. It might be a long match with lots of expenses, so keep that in mind.
My thought is that it's a LONG match. That usually means lots of expenses for you and being out of the pool of applicants for months.
Personally, I wouldn't risk my money before my homestudy was complete...you just never know what kind of things might hold up a homestudy and the last thing you want is the baby being born and you not be homestudy approved...wonder what the agency would do then since you paid all of the expenses??
