We are scheduled for TPR trial this month, with mediation scheduled a few days before the trial.
I know that the point of mediation is to (possiblly) avoid an actual trial. In our case, they are hoping that the mom will do an identified surrender. The dad has never been in the picture.
But, if the parents don't show up - do they proceed with the mediation?
No, they cant do mediation without the parents. Its a "voluntary" process and requires active participation by one or both. If the hope/objective is to see if they will do a voluntary identified surrender to avoid a trial, if they dont show up for mediation, that cant happen!!! But, if they show up on the day of trial and chose to execute the surrender that day, they will be able to do so!!
