My husband and I have let our cw know we are interested in adopting our 2 foster kids. They have been with us for 10 months, dad is mia and has done nothing on plan. Mom has done some, but her progress is not going good at all mainly due to mental health issues. Kids have been in care before, judge has asked cw why she hasn't started tpr last month. She told me the time they were in care before is counting against them. Although we have fostered for almost 8 yrs, the adoption process is not something we are familiar with. So my questions are how long after tpr is filed will it be final? Also, if one parent is on ssi will this follow the kids after they are adopted. I know from reading on here that indiana is not paying subsidy due to lack of funds, and I just wanted to know how hard it is to qualify for this and if this will make the process take longer. We are hoping to be final by the end of the year, does that sound realistic? Thanks for any replies.
I think they have to follow AFSA (15 out of 22mos.) unless both placements have happened with the last two years. I really don't think it will happen by year end, but I could be wrong.

Your kids depending on if they have any sort of special needs, as well as their ages, will probably qualify for Federal Subsidy as we did last year.
Length of time from TPR to adoption will vary on your CW's . . . expertise(how well she keeps up with her paperwork) We had a not so with it on paperwork Cw, it took from Jan to September to get finalized and subsidy took 5 more months because of missing paperwork!
The kids are 4 and 5. They were in care for 6mos then returned home for 17 mos then back in care again so far for 11 mos. I didn't think it would count but when I asked the caseworker she said it is counting against them. Dad has done nothing and mom just isn't getting it. I am just on the fence here about what to do. If judge is asking her why she hasnt filed yet, then should I go ahead and get my atty involved or would I be stepping on toes? I mean at 6mos we can(could've) filed to be a party to the case right? Currently there is no casa/gal so all info I get is when cw comes for her monthly visit. Thnks for replying.
I could be wrong, but I didn't think we could file in IN. I've been doing this for a long time and have never heard of anyone being able to do it in IN. I did some research online and can't find anything supporting it online. Can you link here where you found that?
Have you been going to court hearings? Have they had a permenancy hearing?
We did a permenancy hearing in March that changed case to concurrent plan of RU/Adoption by us. Then began TPR process in May, the plan is for a Default TPR this Friday since Bparents are MIA again. Could be continued if they show but NRE has already been established so TPR will happen.
Anyway, I have the Indiana Adoption Program Application forms now for the IV-E AAP/SAS to fill out and turn in if we TPR like planned.
From what I understand, it will take approx 21 days for TPR paperwork to be completed and then we can file to adopt. I have talked to adoption attorney but until the TPR is complete there is nothing for them to do. We have just verbalized that we want to use them and they agreed to take case once it TPRs.
When it comes to filing to be on case, I haven't heard of that but this is our first to adopt. I have been in every court hearing so far and testified at the permanency hearing in March. Our names are on the permanency paperwork as Adoptive Permanent home if no RU.
Don't know if this helps but this is what going on with us. We are in Indiana DCS licensed fosterparents not with agency so it may be different with agency.

Our daughter is adopted thru FC. TPR was done in Jan 2010, petition to adopt March 2010 and adoption final in May 2010. She also qualified for the Federal AAP subsidy, not the State. They try to qualify child for Federal first and if not then the State which has no funding as you stated. I think it really depends on the attorney you use on how quick they can push it thru. You can hire a lawyer and file to become a party to the CHINS case. The judge has to approve it. You won't be a party to the termination hearing, but you do have the right to attend all hearings and to speak, or have your lawyer speak, at the end of the termination hearing.
Make sure you hire a lawyer that is familiar with the system though.

I know of a family that was able to file a petition to adopt, it was then heard in probate court not juvenile court, it was very expensive but parents had done nothing and I mean nothing on their plan. They adopted, but it was 3 years of more from time of placement. The granting of the petition in effect terminated parental relationships.
Well court did not go as I expected--imagine that. CW was suppose to tell the judge that she was getting paperwork together to file, she didn't even mention it. Other than that she did tell judge everything she said she would. In my opinion it didn't go well for mom. But 2 dys after court cw calls and says we r starting monitored visits 2x's/wk.( for the past yr it has only been 1 per wk for 2 hrs supervised and those were not going well) And so here we are with unsupervised 2 times a wk for 4 hrs now. I just dont get it. birthmom has problems with budgeting, cleanliness, and nutrition among a whole slew of other things and I can't figure out if they r pushing to get them back home asap or giving her just enough rope. I know cw has submitted tpr paperwork to attorney, but don't know if it has been filed yet. As for those of you who drive out of your way to visits, I did get one plus on that. CW emailed me to c where a good place was to meet parents to pu and drop off for visits. I am driving 1 mile. birthmom is driving 20 one way. I know how that sounds to some, but after a yr of not making any effort we shall see how long this last. Thanks for the replies, tried to sum it up as best I could.

on a side note my attorney said we could file to become a party to the case, but that would just give us the ability to sit up front at a table with the rest of the parties and address the court without standing up and asking to do so from the back.
