I am hoping someone will know the answer or be able to give me some advice. I am in NJ and am a host parent for a nonprofit that brings children to the U.S. for medical care. I have been doing this for years and we always love getting the kids as healthy as possible and sending them back to their loving parents. Unfortunately the little man I have now had very serious heart surgery and had serious lung complications. The doctors are concerned if he returns to Haiti and something goes wrong he will die. He came here in horrible condition extremely malnurished. Mom lives in a dirt floored hut over two hours from running water, electricity, or any kind of medical care. She umderstands his only chance for a healthy future is to stay in the U.S. even though it was definately not the original plan. Can someone tell me if this is even possible to be done and where we would start. Would we still have to go through the Haitian approval or can mom just surrender him to us? Thank you for your time.
Unfortunately, he must go back to Haiti when his visa expires. That's not to say you can't adopt him, but it is an international adoption if he only has Haitian citizenship. You must start the process in Haiti. If he overstays a visa, he may welll not be granted an adoption visa later.

It sounds like his medical condition may not yet be stable. I agree, he cannot overstay his visa. However, you could seek to extend his visa at least until he is more stable. I also agree that this would be an international adoption that must have the approval of the Haitian government.
My advise is 1) speak to a very good immigration attorney about seeking an extension of his visa and 2) speak to a VERY qualified and experienced adoption attorney or an accredited international adoption agency that has experience with Haitian adoptions for assistance on how to go forward.
You may also simply call USCIS with questions on the visa. I have found they can be very helpful and understanding. And most reputable international adoption agencies will also be willing to answer your questions and have a discussion about the Haitian adoption process.

Thank you for your replies. I do know of others who have done these type of adoptions without sending the child back to complete it. I have put emails and calls to some of these people but have yet to hear back so I was hoping someone online would have some idea. I am going to call an adoption lawyer today to find out all the details thanks
While such adoptions may have been possible for chiidren originating from other countries, I believe the above poster is correct. Adoption laws in Haiti make it impossible for a foreigner to adopt a child who is not resident in Haiti. According to the US State Department's Haiti information, "Haitian law does not allow for a Haitian child to travel to the United States to be adopted. Therefore, prospective adoptive parents must obtain a full and final adoption under Haitian law before the child can immigrate to the United States. Prospective adoptive parents can expect a lengthy process to adopt a child in Haiti." If you belong to a church, is there any way that your church could financially "sponsor" this family? Maybe the child's mother could at least have a floor laid in her hut, so the youngster doesn't sleep on bare dirt.
