my husband of 4 yrs wants to adopt my daughter from previous relationship. He's been the father figure in my child's life and the only daddy he knows. The BioF agrees to signing off his rights and had stop paying the child support about 5months ago in exchange for his signature which I did agree but now when I told him about the adoption and we are ready to file he all of a sudden change his mind and told me he wont sign his right away all because it is what me and my husband wanted. BioF have not seen the child for over 3 years, my daughter doesn't know him and last time he called to talk to her was 8 months ago which my daughter who is 5 y/o refused to talk to him because he is a stranger, and before that he didn't call for over a year. He only calls few times a week once a year thing for him. BioF said he will fight for it and he wont sign on TPR and no adoption. and also he is suffering from p ts d and currently on a rehab, idk if that will matter in court. Maybe what I am asking is reassurance, I am thinking so much and its mentally consuming. do we have a chance on winning this case? do we have a ground for termination of right? oh we are from tx. did anyone here had a successful contested stepparent adoption? help :(
I was wondering how this worked out for you? The form I typed and sent to him to sign says he understands she may or may not be adopted and he only has 11 days to revoke his signature and it must be done in writting. My daughter's bio father is in prison and I am a little afraid that when he gets the papers I sent the other day and sees the may or may not be adopted part he may change his mind and then we will have to do the involuntary -- however based on him being in prison and him having no contact with her for pretty much never even though he lived in the same town...(plus I have a letter from him that he sent after I approached him about a name change only where he said he would if my husband and I sent him 500 dollars to the prison by the end of that week) I know I have enough grounds to get it done involuntarily, I was just hoping to have him sign and make it easier on my 12 year old. Guess time will tell.
