My wife and I have full and perment custody of our grandchild since she was 14mo old she is now 2. She was taken from birth from the parents and placed in FACs until we could go to court. Question is how can we go about adopting her. We reside in the US., she is from Canada. FACs has told us one thing, INS says another thing. We are very very confussed in this process. We don't want her to be sent back to Canada as she has no one else except us. Thanks in advance
My assumption is that she would have to be adopted under Canadian law, as she is a Canadian citizen. As you are U.S. citizens, this would be an international adoption, meaning that the adoption would be subject to the Hague Convention, since both the U.S. and Canada have ratified this important treaty.
Please consult with an adoption/immigration lawyer who is familiar with adoptions of Canadian children by U.S. citizen relatives.

As a Canadian, as far as I know, this is NOT allowed unfortunately. Honestly, I am pretty sure she should not have been sent out of the country without it already being taken care of. Canadian law does not normally allow for the adoption of its citizens outside the country - EVER. And yes, I have heard of kids being brought back to the country against the objections of their biological parents who wished to place them with an adoptive family.
